1. Acceptance of Terms

By accessing or using Easy Nail Pass™ ("the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these terms, please discontinue use immediately.

2. Service Description

Easy Nail Pass™ is an online educational platform designed to help candidates prepare for US state nail technician license written exams. The Service provides practice questions aligned with the National-Interstate Council of State Boards of Cosmetology (NIC) standard plus state-specific laws and regulations, bilingual study (English alongside Korean, Spanish, or Vietnamese), mock examinations that match each state's format and pass threshold, instant explanations, and progress tracking. Texas (TDLR) is currently supported; New York and California are in development.

Important: Easy Nail Pass™ is an independent test preparation service and is not affiliated with, endorsed by, or sponsored by the National-Interstate Council of State Boards of Cosmetology (NIC), the Texas Department of Licensing and Regulation (TDLR), the New York Department of State, the California Board of Barbering and Cosmetology, or any state or federal government agency. Any references to state board exams are for educational purposes only.

3. Eligibility

The Service is available to individuals of all ages. Users under the age of 13 must have consent from a parent or legal guardian to create an account and use the Service. Users under the age of 18 must have parental consent for any purchases made through the platform. By creating an account, you represent that you meet these eligibility requirements.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and current information during registration and to update your information as necessary. You must notify us immediately of any unauthorized use of your account.

5. Educational Content Disclaimer

All practice questions, translations, explanations, and study materials are provided for educational and test preparation purposes only. While our content is built on the NIC national standard and verified state regulations:

  • We do not guarantee that our content reflects every question or wording you may encounter in your actual state board written exam.
  • Some answers (current state board contact info, fee schedules, regulation citations, etc.) change over time. We update these but cannot guarantee real-time accuracy.
  • We do not guarantee that using our Service will result in passing your state's written or practical nail technician exam or being granted a license to practice.
  • State boards may revise their exams, question pools, pass thresholds, or licensing rules without notice. Always verify with your state board's official website for current guidance (e.g. tdlr.texas.gov for Texas).
6. Payments and Refunds

Pricing: Exam access is available on a per-exam basis or through subscription plans as displayed on the platform. All prices are in U.S. dollars and are subject to change with reasonable notice.

Payment Processing: Payments are processed securely through Stripe. We do not store your credit card information on our servers.

Refund Policy: If you are unsatisfied with your purchase, you may request a refund within 7 days of purchase, provided you have not completed more than 50 percent of the exam content. Refund requests should be sent to aiswingx.com@gmail.com. Free sample questions are non-refundable as they are provided at no cost.

7. Intellectual Property

All content on the Service — including but not limited to questions, explanations, graphics, logos, software, and design — is the property of Easy Nail Pass™ or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission.

8. Acceptable Use

You agree not to:

  • Share, distribute, or resell exam questions or content from the platform.
  • Use automated tools (bots, scrapers) to extract content from the Service.
  • Share your account credentials with others or allow multiple users to access a single account.
  • Attempt to reverse-engineer, decompile, or tamper with the platform's software.
  • Use the Service for any purpose that is unlawful or prohibited by these terms.
  • Upload or transmit viruses, malware, or any harmful content.
9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. We comply with applicable data protection laws, including the Children's Online Privacy Protection Act (COPPA) for users under 13.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Easy Nail Pass™ and its operators shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

  • Your use of or inability to use the Service.
  • Any exam results or academic outcomes.
  • Errors, inaccuracies, or omissions in content, including AI-generated explanations.
  • Service interruptions, outages, or technical failures.
  • Unauthorized access to your account.

Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific requirements. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless Easy Nail Pass™, its operators, and affiliates from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these terms, or your violation of any third-party rights.

13. Account Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these terms, engaged in fraudulent activity, or misused the platform. Upon termination, your access to purchased content may be revoked without refund for cause-based termination.

14. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the United States and the state in which Easy Nail Pass™ is operated, without regard to conflict of law principles. Any disputes arising from these terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or participation in a class action.

15. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, internet or power failures, government actions, pandemics, or cyberattacks.

16. Severability

If any provision of these terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

17. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a prominent notice on the platform. Continued use of the Service after modifications are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
